Terms and Conditions

By signing your contract, you acknowledge that:

  • Once a deposit for services has been made by you and received by Ameritel, you must authorize services to begin within 30 days of the deposit date, or you agree to forfeit the deposit.
  • The monthly service fee (“Service Fee”) set forth in this agreement (“Agreement”) was calculated based upon the length of the term during which the services are to be provided (referred to herein as the “Service Period”), assuming the continuous use of Ameritel’s services for the entire Service Period. Should you elect to terminate Ameritel’s services before the end of the agreed-upon Service Period, you must give a minimum of Sixty (60) Days’ Written notice. Written notice should be sent via email to Brad Martin at the following email address: bmartin@ameritelcloud.com. You expressly agree that if you give proper notice of termination before the end of the Service Period, there will be an early termination fee (“Early Termination Fee”) equal to Sixty Percent (60%) of the remaining balance of the fees that would have been paid during the entire Service Period. (Example: If Twelve (12) months remain in the Service Period, at a rate of Two Hundred Dollars ($200) per month, you agree to pay Ameritel Seven Hundred Twenty Dollars ($720) as the Early Termination Fee.) If you terminate this Agreement without giving the required notice, you expressly agree to pay the entire balance of fees to Ameritel as if you had maintained Ameritel’s services for the entire Service Period.

CHOICE OF LAW/VENUE. Any disputes arising out of or related to this agreement shall be governed exclusively by the laws of the state of Tennessee, without regard to any conflict of laws, and any legal action arising out of or relating to this agreement shall be brought exclusively in the State and/or federal courts located in Hamilton County, Tennessee.

ATTORNEYS’ FEES. In the event of any legal action arising out of or related to this Agreement, the prevailing party shall be entitled to recover all costs associated with prosecuting or defending such action, including without limitation attorneys’ fees and costs of any variety.
